On December 29, 2008, the re-arrest of a vibrant Ethiopian opposition leader, Birtukan Midekssa, set off a debate about Ethiopian pardon law. Her arrest and imprisonment also caused U.S. congressmen1 and senators,2 and their Canadian and European counterparts, to condemn the actions of the ruling Ethiopian Peoples Revolutionary Democratic Forces (“EPRDF”).

    TO BROTHER GIJSA:

I HAVE FULLY UNDERSTOOD WHAT YOU WANT TO SAY IN YOUR COMMENT but don’t be offended for the comment I am going to put her below.

FIRST, what is LAW? Black’s Law Dictionary define the term as follows:
That which is laid down, ordained or established. A rule or method according towhich phenomena or action co-exist or followeach other. In Judical interpretation too, Law is but a body of rule of action or conduct prescribed by controlling authorities and having binding legal force (see United States Fidelityand GuarntyCo. vs. Guenther 281 U.S.34, 50 S.Ct. 165, 74 L.Ed. 683. Law is therfore, be obyed and followed by citizens subject to sanctions or legal consequences because it is a solmemn expression of of the will of the supreme power of the state.

With this universal concept, therefore, there IS law in Ethiopia that only serve the Rulers or the governers, if not the governed. Throught history all tyranical rulers be it Nero, Hitler or Mengistu had laws that only served their interest only. Meles is not exceptional.

The question, therefore, should be whether the law currently currently met international standard, properly interpreted without politicians’ interference and the like. But to say that there is no Law in Ethiopia is an equvallent saying of THERE IS NO A COUNTRY CALLED ETHIOPIA THAT EXIST.

Selam Ato Belew from Montreal, Canada:

I have read your article and attempted to review your attachments (http://Ethiotube,net). I did not find your suggested documents for reading on the link but Meles Zenawi’ Parliamentary discussion on the proposed motion by President Girma as well as Tedy Afro’s appearance for public event and several Ethiopian Idols. None of these are helpful to our discussion. Therefore, I shall address our difference on its own merit as we have posted in this website repectively.

Firs and formost, I must point out the core difference of our view. I said there is LAW IN ETHIOPIA whether that law is right or wrong. You said, “There is no independant Judiciary in Ethiopia. The difference of our view, is therefore, between your understanding of judicial independence (no extrajudicial- that is, interference by authority on the the judges’ ruling)in rendering judgement according to their understanding and interpretation of the law itself, guided by their moral integerity and degree of discretion that they may apply to effectuate justice. The other examples you mentioned in support of your argument, i.e.,(1)Commentary on the Ethiopian Civil Code and (2)Divorce Division of Wealth) doesn’t help because you are still talking about judicial independence NOT the existance of the law itself. In other word, the commentaries are opinion supplied to the interesting party in the school of thought either insupport or against of the law that already EXISTED. The same rationale apply in this case to the other economic issue (Divorce and division of Wealth.)

PS.:- sorry for writing in English because I have difficulty in using multiple keys to write desired Amharic words.

    ……….CONTINUED FROM COMMENT NO. 9…..

(AS THE ABOVE WAS MINTAKENLY SEND BEFORE FINISHING MY POINT)

In conclusion, I must point out that my original commeny indicated above, is in consistent with the comment made by Mr.GIJSA, (comment No.1)because he alleged that “First of all there is no law as such in Ethiopia”. Notwithstanding withis fandamental assertion, he also said that ” the judges are appointed by …. In short, there is no independant judiciary in Ethiopia”.

Here, the flow of the argument is simple. IF THERE IS NO LAW IN ETHIOPIA, THERE IS NO NEED TO APPOINT JUDGES BE IT BIASED OR INDEPENDANT OR HONORABLE. Mr.Belew, your argument is similar to Mr. GIJSA and therefore, you did not give me space to discuss this issue in detail. However, Thank you for your effort to teach or learn.

Thank you for your response. As there is no substantial issue remained for discussion, I have no further comment. However, I want to correct your erroneous assumption concerning my PEN NAME in this Website. My pen name is “ETHIOPIAN from Boston” not in the plural, “ETHIOPIANS” from Boston. Therefore, I did not represent any Bostonians in this website’s dialoge but only myself. Thank you for observation.
