It is reported by several media outlets and international human rights organizations, such as Amnesty International, that on 8 July 2014, the Ethiopian Television (ETV) had announced and presented a video of Andargachew Tsige, Secretary General of the outlawed Ginbot 7 movement, under custody. It is also reported that Andargachew Tsige, who was in transit to Asmara, Eritrea, had disappeared on 23/24 June 2014 in Yemen after his plane had landed at Sana’a Airport, and that he was handed over to Ethiopian security authorities the same day and flown out to Addis Ababa where he is now in detention in undisclosed location.

It is not a print/clerical error that I wrote “abducting” in reference to the tragic event that took place on June 23/24 in Sana’a, the forceful arrest and delivery of a legitimate international traveler in transit at the Sana’a Airport in Yemen to Ethiopian authorities. I read in reports of journalists and official press statements of governments using the term “extradition” in referring to the arrest and later transfer of the opposition leader Andargachew Tsige to Ethiopia.

The legal term “extradition” is being used loosely by some parties to the conflict. Extradition is carried out in a formal process either pursuant to a treaty or in international comity in the absence of an extradition treaty. Neither process was undertaken in this particular case. There is no extradition treaty between Ethiopia and Yemen, and the international comity process would require either judicial or administrative formal hearing, but neither form of legal process was carried out. Thus the use of the term “extradition” is improper and does gloss over the illegality of the actions of the two governments against the individual rights of Andargachew Tsige.

Ethiopian Government Priority Number One: Arrest Mengistu Hailemariam
Starting with Meles Zenawi, the most controversial Ethiopian leader ever in the history of Ethiopia, Ethiopian leaders after the Second World War had shown very little regard to the well-being of individual Ethiopians. Despite the fact that Ethiopian past and present leaders claim how intensely committed they are/were to the development of Ethiopia, they hardly ever translate their claims to reality on the ground by dedicating themselves to helping individual Ethiopians. The Ethiopian Government leaders and their officials in key governmental authority seem to have no sense of what is in the best interest of the State of Ethiopia and/or its citizens.

It is absolutely Kafkaian what the Ethiopian Government is doing in abducting Andargachew Tsige while the internationally condemned criminals Mengistu Hailemariam and his close associates who are/were the Red Terror perpetrators, the murderers and torturers of thousands of innocent Ethiopians, young and old, men and women and children, are freely living [for Mengistu in luxury] in Zimbabwe and elsewhere in the Western World, and yet an individual who has not murdered, or tortured, or detained a single Ethiopian is hunted down and illegally abducted while in transit on an international flight stop-over. How could any rational person explain or justify such ridicules activities of the current Ethiopian Leaders and their Government?

It is simple common sense not to draw attention to ones flawed system of government by getting involved in horrendous public criminal activities such as abductions, arresting opposition leaders, arresting journalists and bloggers et cetera. But that is precisely what the Ethiopian Government leadership is doing. Such bad governance and abuse of individual human and democratic rights of Ethiopians erodes the image of the current Ethiopian Government. At a time like this where there is the looming controversy with Egypt over the GERD, and no less devastating controversy with many of the Arab countries including Saudi Arabia on the flow of Ethiopian migrant workers et cetera, Ethiopia does not need to draw attention to itself due to the violent activities of its leaders.

Ethiopia’s current leaders, no matter how their backward and antiquated political behavior was shaped by their primitive upbringing in rustic environment of deprivation and brutality, they have had some twenty years of power, wealth and luxurious life, and full exposure to the outside world. There are no excuses to behaving like street gangs and thugs terrorizing and brutalizing citizens. I have heard some street talks that Prime Minister Hailemariam Desalegn did not know of the government‘s action to arrest Andargachew Tsige. If the abduction of Andargachew was done without the knowledge and order or consent of Hilemariam, the country is in real controversy, indeed. I have written at my own risk advocating that we Diaspora politicians give time for Hailemariam Desalegn, that change cannot be achieved overnight et cetera. I still believe in evolutionary change, but I am not as optimistic as I was early on whether Hailemariam Desalegn is the right person to bring about genuine and transformative change in Ethiopia.

The politics of Ginbot-7
Lawlessness by anybody in any form is unacceptable. Personally, I do not like the political stand of Andargachew Tsige, and even more so that of his political Organization, Ginbot-7. In fact, I have absolute contempt for their vainglorious willingness to submit themselves to the dictates of a determined anti-Ethiopia dictator Issayas Afeworki who had taken steps against Ethiopia’s national security and economic interest both openly and covertly for several decades. I cannot accept any excuse by anybody to side with any enemy of Ethiopia. I have even condemned Meles Zenawi and his members of the leadership of the TPLF for receiving aid from the Sudan, Somalia, and Egypt in fighting against the brutal Mengistu Hailemariam and his soldiers, and to this day I still consider that as a betrayal of Ethiopia because those countries were not friends of Ethiopia. However, help from any other country such as the United States, Britain, France et cetera would not have been as offensive to me as help from Governments that are enemies of Ethiopia.

The issue of the abduction of a person who is in a legitimate aviation transit violates all kinds of international law including international aviation conventions and practices. Whether I support the political program of Ginbot-7 and/or its leadership is immaterial. The issue now is much deeper and of much intense magnitude than mere support or opposition of a political organization or its leadership. It now involves the fundamental rights of an individual subject of international law and norms that is so foundational that the principle of Jus Cogens is applicable as well. [Jus cogens (from Latin: compelling law; English: peremptory norm) refers to certain fundamental, overriding principles of international law, from which no derogation is ever permitted. See Ian Brownlie, Principles of Public International Law (5th ed., Oxford, 1998).]

I happen to be a believer that the means used to achieve a noble goal need be noble itself. I do not accept the cynical idea that that the end would justify the means. Here is where most of our political perceptions falter. There are very many compelling reasons given by knowledgeable individuals that sometime using certain illegal or immoral means is justified if the result is beneficial to society. I do not support such outright opportunistic method that might even be illegal and hurtful to some. I did advocate in few of my past articles for compromise and accommodation of weaknesses in some members of society in order to create an overall harmony within communities.

Addressing Endargchew Tsige, Have Courage
I have watched with dismay the disheveled image of Andargachew Tsige on a video presented by the Ethiopian Government Television program. I heard him making statements that are incomprehensible and utter nonsense about him being desirous of rest that he does not harbor any grudges or ill-will toward anybody. Now I am addressing you Andargachew directly: No matter what you do to placate those in power who abducted you, it will not work. You might as well show courage and public defiance in dealing with your captors. Do not make pathetic remarks how you are tired and want some peaceful rest, or that you do not harbor any resentment to anyone. I was reminded by that statement how Birtukan Midekisa was reduced to a pathetic figure by the statement she signed in order to secure here release from prison, a statement that was drafted by Meles Zenawi. You seem to be reading from scripts provided you by Amnesty International. Whatever your fate maybe at this late stage, accept it and leave your Family members and political followers something to be proud of.

The authorities that are detaining you are not monolithic and some have no honor or compassion. Some of those same leaders have displayed time after time their brutality and violent nature. I am sorry that you were caught off guard, for I assume that you might have taken some precaution to ensure that you will not be victimized this easily. Now, we are talking about the morning-after: to what extent the outside world and your followers would help you attain your freedom is very tenuous, but if pursued with vigor and in large numbers, it might succeed.

The native people of this country used an aphorism by stating that walking in someone else’s moccasins is the best way to understand that such individual. I understand Andargachew Tsige, for his motivation though extreme and not politically wise or savvy, has elements of a school-boy’s idealism. Though I have never personally met him, I have heard him presenting ideas when he was a member I believe of the EPRDF through his political organization the EPDM, at a crucial and tasking time for EPDM and EPRDF in general, and later in the Washington area in one of those endless presentations at hotel auditoriums.

I have read the official statements made by the Ethiopian Government officials on pronouncing the death sentences on individuals tried in absentia for plotting the murder of some Ethiopian Government officials. It is absolutely a flawed judicial process that provides for the condemnation of anyone to death based on the hearsay (not properly cross-examined by defense counsel) testimony of codefendants. Even if we admit that hearsay as the exception to the rules on hearsay evidence/testimony, there is an insurmountable test of criminality of realistic evaluation whether what was conspired for was within possibilities, for individuals can fantasize on any number of things but that does not translate into a criminal activity automatically—some showing is necessary.

One might also consider the problem why we Ethiopians failed repeatedly to produce good leaders as a consequence of a social and a cultural system that systematically eliminated the Alpha-male from the community through brutal leveling discipline right from childhood throughout one’s life. And those that survive that form of abuse from family members, teachers et cetera finally would meet their demise in the hands of dictatorial regimes. What might be left behind, after all the negative pruning is a population that suffers from deep seated psychological destructive energy unable to channel properly such energy into constructive social responses. What we have become in general is narcissistic—shallow, uncooperative, and megalomaniac individuals suffering from a Napoleonic syndrome of grandeur on one hand, and a devastating feeling of insecurity on the other hand.

My last words are meant to the ears of the Ethiopian Government Leaders: By violating international law and norms, you are not helping the causes of Ethiopia. There is no need to arrest, detain, torture, kill et cetera anyone for political reasons or otherwise. There is a bright future for Ethiopia if only you become transparent and approachable to all Ethiopians. There is much to be done and there is no need for adding controversy after controversy to an already fragile Ethiopia. What do you gain for Ethiopia by imprisoning individuals like Eskinder Nega, Reeyot Alemu, Andualem Arage, the young bloggers, and countless others, or now abducting Andargachew Tsige? As political leaders you must not act because of bruised ego, selfish motives, ethnic biases, religious intolerance et cetera. Above all do not be afraid of your fellow Ethiopians, for the public has a fifth sense, and can sense insecurity in its leaders even from a distance. There is nothing worse than losing the trust of your fellow Ethiopians. The use of force cannot solve everything especially political controversy. Now, I urge you to release all political detainees and prisoners including Andargachew Tsige.

    I applaud you for taking a stand on the manner in which Andargachew was abducted. This could not have happened without knowledge of the British [or for that matter the US] government. I too do not agree with the strategy G7 has devised to work with Eritrea. Unlike you, I am for replacing Tplf-led government with a more representative one. As for Mengistu Hailemariam there is now emerging a consensus that he may not be as bad as he was made out to be. Many are pointing to four factors. 1/ Mengistu and his government was not as corrupt as the Tplf-led; 2/ Mengistu did more to stand for the territorial integrity of the country [though his use of violence was counterproductive]; 3/ Tplf-led government came in promising free and fair elections, the rule of law, and economic freedom; citizens can now vote but only if Tplf-led coalition won, the courts are politicized, and the economy is state-led. 4/’Land to the tiller’ for which many lost their lives was reversed by Tplf for political reasons. Further, Mengistu’s government never ethnicized appointments or segregated the economy. Tigrayans are in charge of key posts in politics, military, and economy; Tigrayans could run businesses in all regions; others are relegated to their own; none in Tigray region. EFFORT is a multi-million dollar business conglomerate set up with aid money and interest-free bank loans but serving interests of Tplf leaders and Tigray region. No one could question its operations or demand investigation. In Benishagnul-Gumuz bamboo and gold business licenses are issued only to Tigrayans; I could go on listing coffee, construction, trucking, khat, etc. Coalition party leaders are appointees of the Tplf. You know all this; I am repeating this for those who may be coming across this discussion for the first time.

    Yes Mengistu must face justice. Yes Mengistu should be seen in the context of the world he operated within. The West was decidedly against him; Russians were ever suspicious of his intentions [or as they put it his nationalistic fervor]; Eprp of which you were a member was looking for his head as did Meison, Olf, Tplf, and Eplf. In other words, none of the leaders of the opposition wanted to settle disputes peacefully. None. None could see the damage [both short-term and long-term] to the nation. Mind you I have always been opposed to Derg-rule; the interesting development at present is that many Ethiopians are re-considering those days up against what Tplf-led government is doing to citizens and to the country. Do you realize tens of thousands are fleeing their own country because there is no economic opportunity; and for those who organize to enlarge the political space prison and the torture chamber is their destination. I appeal to you by birth-mother’s compassion to stop pointing fingers at the mostly aimless and destructive opposition and stand in the gap for those whose future is being denied them.

    It is unconvincing and dishonest on your part to state that the hydro-project over the Nile is significant without laying out the economic terrain in its entirety. Citizens have to go through 16 years of educational training to end up laying cobblestone?

    Meles [posthumously], Seye, Seyoum, Sebhat Nega, etc. should also face justice. I know you count yourself a humanitarian, guided by strong humanitarian principles. Think with me now; should the deaths of 70,000 youths for a war that served no purpose whatsoever be swept under the carpet? For how long? Do you realize how this might have affected those who survived them and the lost economic and spiritual potential to society as a whole? How about the more than 16 billion dollars illicitly transferred to foreign banks?

    You keep repeating Hailemariam is in control. Should I be the one to tell you you either are deceived or deliberately deceiving? Yes we all see the face is that of Hailemariam; the voice, however, is patently Tplf’s. If Hailemariam had an ounce of integrity left within his soul the honorable thing for him to do is to resign. More and more he sounds like he is intent to outlie Meles.

    I find your suggesting that Andargachew should speak his mind very naive. After all, what was cast on television was doctored as well as taped beforehand. You are right in underlining the inhuman treatment the present regime is known for serving. Can you believe Zone 9 Bloggers are still in jail illegally for over 65 days?

    Your present write-up is good but not good enough. It should be translated into an actionable plan. International legal experts like yourself should get together and lodge complaints/send summary reports to international bodies in regard to crimes of Mengistu, Meles, Seeye, Sebhat, Seyoum, etc. I commend you for raising it; I hope you will carry it through to, if need be, the international court.

    You are simply, in one word, an OPPORTUNIST. That too of the highest form.

    - You are advising not to trust and work harmoniously with neighbors but open the doors for far distant countries.

    - Dead or alive statements for terrorists from westerners are fine with you but for African are questionable.

    - Ethiopian leaders are not doing any different, whether it is extradition or abduction, it is learned from your masters. The knowledge of the two words would have been much better without mentioning Andargachew.

    - No one has any right to judge any person under arrest for any of the person’s statement, that too whether tortured or not. No need to show bravado and demean those who are in hell hole.

    - The least one can do for those who are under arrest is pray for ease of pain rather than ridiculing for their statements under duress. As professional law person you must know what it means duress is and it’s value.

    Dear Prof. Hagos, reading your essays, I always try my best to read between the lines as you seem to write in a vague and contradictory terms. I don’t understand your utter negligence of the treaty between the countries Ethiopia and Yemen. Unless you are lining up yourself with those who articulate a treaty between two “failed countries” doesn’t amount to much, there is a treaty which is legal and binding. But the broader point you missing is, treaties or not, the very fact that this individual has declared war against a government which boasts to being elected by the people – it’s validity is another matter of course. In addition, he was labeled as terrorist and has been sentenced to death in absentia by the government and the courts respectively. Unless you come from a twisted political view that says what this government in general and the courts in particular do is a lawless act, then I don’t see your argument that this government has no moral obligation to do what ever measure it deems necessary to apprehend and take out those kinds of people from harming the peoples interest (poor man’s drone). Where you should applaud them for their tenacity to go after a declared enemy who shares the pillow with another known troublemaker-in-chief (Afeworki), you stayed true to your “Diaspora politician” mantra by lecturing them, instead , who they have to apprehend first. Is that your view that they are incapable to walk and chew a gum? Lastly, your comment about “By violating international law and norms, you are not helping the causes of Ethiopia.” is missing the realty. Do you think for a minute that the likes of HRW, AI, GenocideWatch, Anna Gomez, ESAT, etc will start saying something good about this government no matter what they do? They have their own agenda and it doesn’t align with the government’s world view. That is indisputable fact. As far as I can tell, “..The causes of Ethiopia” are not hurt when it comes to aid and investment from the international community as demonstrated by Britain after Andy’s arrest. In conclusion, the message and lessons we need to emphasize from Andy’s arrest is that in a place where there’s a space for disagreement – be it a narrow one – resorting to old and narrow minded political engagement as exhibited by the likes of Dr. Birhanu and Andargachew is a one way street with no return. If you engage in such twisted and outdated activities, the government is more than capable to hold its own. That should be the moral of this “abduction” – to give you the last word.

    In my view you failed to understand the exact import of his words by saying he was attempting to ‘placate’ his enemies. Contrary to your charge, Andargachew said,”I am not angry! I am not in despair! I am at peace with myself! I finished my mission! I just want rest! Andargatchew uttered these words with Eternity in his immediate view. Therefore, these are the word’s a patriot, a hero, and of a martyr. Indeed the freedom of Ethiopians must be sprinkled by her YEKURT LET JGNOCH.

    My question for you is why you are driveling here. Specially, your charge concerning the relationship between G-7 and what you referred Eretria the enemy of Ethiopia. But, what does this mean for you? Were you bothered in any way when Shabia put TPLF in Menelik palace 23 years ago in which you were a leading participant in that new order?

    Andargachew is indeed hero! You have no moral value to criticize him sitting in your comfort from abroad. The meaning of life is not measured by how long one lives for his belly. Rather, how one lives it fruitfully, productively not for self-interest but for a greater cause.
    I don’t put in the same box the one who is a notorious Mehal Sefari, Tensheratach ,and Aderbaye Mehur and one who is ready to be a martyr because he had already prepared himself for such a mission. I myself once was not a fan of being assisted by Eretria. Not anymore! TPLF must go and it will be taken out with the collaboration of Eretria and Ethiopia as fast as a speed of light. The remnant of TPLF bandits know this very well than the rest of us like to admit. And when Andargachew spoke about the blessing in disguise he might have this in view.

    I have read several such comments by folks but, we are talking about a guy who just got abducted, probably that interview took place within hours of the abduction as his sister Eskedar figured out. Under such circumstances his behavior wasn’t more distressful than say a man who just missed a last air-flight to attend a brother’s wedding. So not that bad!

    I find the following comment to be more fitting. BTW, Dr. Berhanu has confirmed on ESAT earlier that Andargachew has completed his assignments and was getting ready to rest.

    To defend and protect the country is a priority. Andargachw was not ” an innocent legitimate international traveler”. You are smart you know that. To fulfill your hidden agenda you refused to see that fact. You defend the country by stopping those who are sworn to destroy the country by sleeping with our arch enemies like Eritrea.

    Tecola, you mixed up a lot of fiction and facts and as a result, you lost your credibility. On one way, you disagree with the policy of Ginbot 7 and on the other hand, you object the arrest of Andargachw. Are you saying the government pass this opportunity? He admits and his ticket indicates that he is going to Eritrea. You can google that the guy has been in Eritrea training and arming fighter against Ethiopia. What else do you want?

    Please allow me to join you in your very wise advice to those who are in charge of the regime back home. This is what I want to say to them:

    I want to remind concerned officials of the regime back home that subjecting defenseless prisoner to physical torture is a crime that the world around you will never forget and I urge you to refrain from this cruel practice. You may feel now that you are indomitable but that was how the former Emperor thought. That was how Mengistu thought. That was how Ziad Barre thought. That was something Sadaam never doubted for a second. Something unthinkable has had happened to all of them. They are gone and gone for good not necessarily in dignified ways. Most of them had subjected political prisoners to agonizing physical torture, sent them to long term imprisonments and executed them whenever they liked it. Do not torture this family man and you should bring him to court as soon as possible so the rest of the world can see. You should give his family and concerned diplomatic staff access to this prisoner. He should be provided with proper counseling immediately. These prisoner rights are right there in your own constitution in black and white. Above all, Ethiopia is a signatory of the Geneva Convention and other similar agreements related to prisoners safety. You should never forget that. That is all I want to say.

    I also agree with the author who should be the priority and in the cross hair the current regime back home in bringing past gross violators of human and democratic rights especially those who callously murdered their opponents at will. I share my suspicion with the author that some of those savage killers and torturers of the Mengistu era may be waking among us as we speak quietly thumbing their noses at justice denied. The mockery of all justice can be if any of them have been able to re-badge themselves as leaders in any of the opposition groups. I think what those victims and their families of the red terror of the 1970′s and 80′s need is an organization similar to The Simon Wiesenthal Center with a sole mission of tracking down all those who committed atrocities during that terrible period in our history. Those are savage animals that do not deserve a second of freedom outside prison gates.

    Lastly, I want to repeat my question to the organization of this abducted person that I had asked before. Why did they go and collude with a proven human and democratic rights violator in Asmara who rules over his own people with pointed and cocked guns? I am not making this up. You need to look at reports upon reports of many neutral human rights organizations and recently the complaints of gallant religious leaders from inside that country. Eritrea and its people should left alone to their own device that will remain within their own territory. Who elected him a ‘liberator’ as a ‘Simon Bolivar’ of the Horn of Africa? When was such an election took place? When and where? In 1993 they had overwhelmingly voted to going alone and wanted nothing to do with the rest of us. What the goon in Asmara wants to see among us is a bloody hullabaloo preferably along ethnic lines so he can fish in the troubled waters. That despot along with his lieutenants will not rest until they see us killing and butchering each other to a vertical anarchy. That is their ultimate plan with out the shadow of a doubt. In my book, all those who aligned themselves with this despot and his entourage are nothing less than committing a grave mistake that will put our people in harms way. And I am not alone. 90 millions of them agree with me. Call me what ever you want but that is what I stubbornly believe.

    Again and a usual, this is my 2 cents worth of opinion and advice.

    The abduction and rendition of ato Andargachew Tsige violated international laws and human rights. The TPLF ethnic dictators do not have any regard for these laws and norms and behave and rule like bandits in the bush. The TPLF is an ethnical fascist front and uses all the means it musters to stay in power. Professor Tecola knows that the TPLF is the handwork and creation of the EPLF (Isaias Afewerki. The number of Tigrayans (90-130,000) that perished to crown Isaias Afewerki were by far more than that of the EPLF.     The immediate transfer of Andargachew to Addis Ababa and the amount of money spent on Andargachew (close to 3.5 milllion dollar) speak volumes. It reveals the depth of TPLF/EPRDF’s fear. EPRDF never cared to spend that kind of money and never was quick to act like that for other opposition parties except G7.

    I respect Prof Tecola highly as a learned professor of the highest caliber with deep love for his country. But I register my difference with him in this article in which he says G7 was wrong to work with Eritrea.

    Prof Tecola, Ethiopians cannot continue to suffer like that under TPLF. We waited 23 years without change to our suffering. We are not living under TPLF mistreatment to go to heaven. We want our life on earth too. We cannot allow TPLf to take away our rights. G7′s choice to work with Eritrea to remove TPLf is right and just. The arrest of Andargachew and the amount of money spent on this only man tells us how effective work G7 has been conducting in Eritrea. Many try to corner leaders of G7 including ESAT journalists by asking what are you doing. G7 leaders should not fall in this trap. It takes time to build a formidable army and organizational skill to topple one of Africas’ militarize government and a rich party like TPLF. It is clear that G7 has to strengthen its security operations and that by itself is a process. And following such tasks, G7 is not to start a war against TPLF out right as many including ESAT journalists are pressing. G& people should be cool headed and take things at a time.

    Their formidable action at this time should be attack well studied strategic places and retreat. Attack of these places should lead to enormous loss that would affect the health of the economy seriously. . And there are other actions to be taken to shiver this government. Let them start things one at a time. Let them alone to do their job.

Look what happened to Andargachew Tsege.He did not go to Yemen as an Ethiopian but as a British with British passport and imagine how much contempt the Yemen government had for the passport Andaregachew carried. Regardless of Andargachew’s nationality, the Yemen government extradited him to Ethiopia as an Ethiopian. Who gave the Yemen government the right to treat a British citizen as an Ethiopian and send him to Ethiopia. Did it receive a go ahead from London because Britain does not care for its naturalized citizen? Andargachew would not have stayed this long in prison if the British government had believed Andargachew as its citizen.

    The end game of this article is that you are doing fine as a legitimate government body but you violated the individual rights according to international law for abducting Ato Andargachew Tigue, the secretary General of Ginbot 7, eventhough I do not support his political views.     If you mean by control similar to former Meles he is not but he is not expected to have the same control as the extraordinary man to begin with; that was perhaps a historical requirement for meles to be that much in “control”; no body else would be that because it is not even necessary IMO. As we see EPRDF is back to its collective leadership. That suits the country for now.

    HD in his last interview has explained how exceptional his predecessor was; next to god! :-) Further more, he said he has seen many world leaders in his career but none of them are close to Meles’s caliber. He also said if I am allowed to paraphrase that Meles was a rare occurrence in the world and perhaps god’s gift to Ethiopia. There is nothing new of what he said there; Dr Susan, Prof. Andreas and others have said similar things.

    Having said that, under the circumstances HD has as good of a control as any other dedicated prime minster would follow the foot steps of the monumental former prime minster. The fact that he was selected and ordained by the great leader makes him even more special.

    The bottom line my friend is that the Developmental State Model is already in place; what is left for any prime minister is implementing the plan and HD has dedicated his life to do that and no one can take away that from him.

    Taxonomy as you seem to repeatedly point out in all your posts may have been a major factor when TPLF started and the following years but now it is subsiding. I say it will completely die in the coming years; we have seen in the past that even if you are one of the founders of TPLF/EPRDF and you are out of line you end up in jail. Seye and others are examples of that.

    Lately, after the developmental state is implemented what counts has become more and more the party line not your ethnicity. I say, already HD is taking it even further more in that direction to its ultimate death bed for the sake of a United Ethiopa.

    Thank you for the note. I do not consider national security treaties as “extradition” treaties, in reference to the Ethio-Yemeni Security Treaty of 1999. Yes, there was signed a security agreement between Meles Zenawi and the then Yemeni President in 1999; even then it is not clear whether follow-up and proper local procedures were undertaken in either States as the ratification process. Furthermore, the agreement was not deposited with the United Nations, where I checked and I did not see any record of it either. At best what we have is a political oriented instrument and a not juridical oriented one, which is not the essence of having an extradition treaty. In almost all extradition treaties I checked, any extradition request that has political reason as its base is disallowed or excepted.

    Your other comment about national security and the right for a state to defend itself against “political” based attacks proves my point why there is no “extradition” treaty but a national security one. Thanks.

    Thank you for your article. I share your concern about Ethiopian political leaders who apologize to the murdErer TPLF regime. Birtukan’s case is a tragedy. I wish she didn’t ask Melese for pardon the second time. I am sure it will haunt her for the rest of her life.On the other hand, Andargachew is a LION.I listened several times what they transmitted. His voice is hardly audible and the video clip is clearly tampered.So far he is a hero and he is moving the struggle much more than he could ever achieve roaming around as a “free man” in London or Asmera. To borrow a phrase from him his abduction is a “blessing in disguise”. The struggle got the fuel it badly needed. Let me tell you its effect on me and on several of my friends and associates:
    1. Now I am pro-Eriteria and support Esayiyas. Esayiyas did not do a fraction of the damage that Melese and his TPLF stooges inflicted on Ethiopia. We will never get back our sea ports as long as TPLF is in power. No one is trying hard to appease Esayiyas than the traitors in Arat Kilo.They are now begging Esayiyas to receive “free” electricty through Sudan. The Eriterins that were expelled during the war are now allowed to return and there are more Eriterian in the corridor of power than any other etnic group but Tigrian. The Ambo masscare was triggered when the TPLF plan to settle large number of Tigrians and Eriterians in Addis and its environs was reveled. So do you get it? What more will Ginbot-7 or anyone give to Eriterians?
    2. I will support financially and otherwise Ginbot-7. I hope they have structural ability to channel all this support that they are getting and will do something concrete on the ground;
    3. I will work harder to end the apartheid TPLF regime in Ethiopia. For now I am ANDARGACHEW and declare “NO DESPAIR”

    The sooner we abandon this “free market” madness, the sooner we can answer the bigger question: how do we create a means of economic organization which has the highest chance of meeting our social goals?

    I have no problem in trying individuals for committing murder, torture, crime against humanity, genocide, and treason, during activities claimed to be part of some political motivated activities. I set no statute of limitation and/or double jeopardy protection for such criminals. Thus hiding from justice and the judicial process should not be a refugee from prosecution. For example, the United States, true to its history of allowing Nazi criminals from the Holocaust period of the Second World War to settle in the States, has allowed three generation of criminals from Haile Selassie regime, from Mengistu Hailemariam regime, and now from Meles Zenawi regime. The United States has also allowed criminals from political organizations that had committed similar crimes as government leaders over the period of the last half a century.

    I believe allowing political leaders, military commanders, and functionaries who committed such crimes to live through their normal length of lives without ever charging them with their crimes and properly punishing them for the crimes they committed is in itself a criminal act. I do not believe in political motivated “forgiveness” as Meles Zenawi did with the notorious government leaders, military commanders and brutal functionaries of Mengistu’s regime. By such act Meles has committed another crime against all those who were victims all over again, this is in addition to the many treasons of compromising the sovereignty and territorial integrity of Ethiopia he committed.

    I strongly believe Ethiopia can only heal if such past criminals as indicated above are brought to justice and punished for their crimes. Alem listed few individuals from the current regime of EPRDF/TPLF, but many more should be added to that list including individuals from EPRP, Meison, OLF and many other political organizations. The law of war and the rules of engagement apply not only to governments but also to organized insurrections, rebellion, freedom fighters, and liberation fronts. I will include in that group of criminals religious instigators who committed atrocities against different religious groups or individuals with different religion. However, no two crimes are equal in their devastation on Ethiopian victims.

    This idea of prosecuting political leaders and their functionaries for crimes against humanity et cetera is not some new idea for me, if you had followed my articles carefully you would not have any ground for your derogatory statements.

    That is exactly why EPRDF has to handle Andargachew and others like him in a dignified manner. He was a friend of Meles but became impatient of the pragmatism of his friend. His friend has the responsibility for all of his followers; including the narrow nationalists. After all they are the horses that brought him to power. He perhaps took too much of his sweet time respecting the loyalty of all his followers more than what Andargachew, Berhanu or Bertukan would like him to. They all fall apart because of that.

    I say, if there was a time line and they all lived long enough to see that day, it is likely Andy, Meles, Berhanu and Bertukan would have one day joined coalitions of sorts to work together and see their people continue the rapid democratization process. Meles has dropped out but they can still do same with HD down the line.

    As the government has the upper hand, it should handle the matter delicately by giving all a playing space in their country so that they don’t resort to violence.

    How does Tecola flip flops in many stances?
    1)In one of his previous pieces he wrote demeaning article about Kings Teodros and Minilik. What he got in return from Diaspora Ethiopians, who he dislikes most, was barraging disapproval and condemnation.
    Now in this article he wants to appease the same Diaspora, took off his hands from those kings and wrote the following. “…..Starting with Meles Zenawi, the most controversial Ethiopian leader ever in the history of Ethiopia, Ethiopian leaders after the Second World War had shown very little regard to the well-being of individual Ethiopians. “Really??? What a new discovery professor? Tecola thinks that this is somehow a new finding ¬¬¬¬that is not known by majority of his countrymen and wants to shade light on it. “Now it looks like that he is taking back his curse by saying in effect, the kings before Second World War were better in handling the welfare of their subjects. What a dramatic conciliatory turn?
    Such emotionally immature, condescending nature and pompous remarks in most of Tecola’s articles compelled the majority of Abugida readers to be against his useless scribbles. As a learned citizen, he should point out the way out from our vicious circle dilemmas instead of cursing left and right in every opportunity that he gets. The professor looks so vindictive and resentful but sugarcoating his feelings with justice and dares to tell the bandits to go after Mengistu H/M and has a nerve to tell Andargachew, that he failed to answer his captor’s interrogation to his satisfaction. As I see it apart from being bitter he is so biased and selective for whom he seeks justice to be served. He turns a blind eye for those corrupt criminals in power including Siye and numerous corrupt tplfites. Who knows what Tecola who becomes justice advocate of today, has done when he was eprp and then when he was serving as TPLF top man advisor? Apparently, it looks like he failed to observe the dictum that says when you point your index finger on someone four are pointing to thyself.
    2) Tecola was accusing Al Mariam of treason for his opinion on the Nile dam project, but fells short to call Meles Zenawi treasonous mafia, instead for some reason he leniently called him the most controversial leader ever in the history.
    Is the word controversial being suitable enough for Tecola to call the nameless devil that caused enormous suffering and put open ended time bombs for those 90 million plus Ethiopians?
    3) professor T was advocating for HD at one time by lambasting Diaspora regime opponents who believes that HD was handpicked opportunist and a Trojan horse for tplf and now he is about to say HD was not as he expected him to be. It was Tecola’s passion with ETV that makes him believe and put forward his arguments based on ETV propaganda. But the reality is different from ETV hoopla. It is just an opinion that reflects TPLF policy not facts. One cannot win a case based on opinion and the law professor understands this better.
    4) “….such bad governance and abuse of individual human and democratic rights of Ethiopian erodes the image of the current Ethiopian government” In the eyes of this professor who is glued to ETV day and night, the image of the current Ethiopian government is still in a good shape and he fears that this image will be tarnished if they abduct and throw everyone who dares to speak the truth to jail. This is the dissimilarity between Tecola and the opponents of the regime namely most Diaspora including myself that they believe that the image of these thugs sitting at the name of government has already been tarnished from the outset. But for this professor he thinks that their image is refined and still intact.
    Sometimes, I am wondering how our bright minds or the so called educated ones could go south in their analytical thinking and logical approach of any given situation be it political, economic or social affairs. Regrettably, it is absurdity in play.

The question now is how to get Ethiopian intellectuals and civic leaders to compile the necessary documents and lodge an overdue complaint to international bodies.     Thank you for your matured view on Andargachew. What we are witnessing is a completly intolerent and unaccomodating group at the helm. The late Degazemach Zewde counseled Melese that etnocentrism is determental to Ethiopia. No doubt, though you are alarmed, you try to crack a jock out of a sad situation. The kidnaping of Andargachew and the ongoing torture that he is enduring is a watershed event for the movement to Liberate Ethiopia. The TPLF central core led by Workeneh,Gebeyehu, Debretsion Gebremichile,Getachew Asefa, Berket Simon and weyane General Mohamed Yonus has made it clear the only alternative to Ethiopians is to be willing subjects to their cabal. This is TPLF’s end game. The kidnaping of Andargachew and his ongoing torture is the water shed moment for the Ethiopian resistance. On the one hand, such blatant act on international soil by TPLF against leading opposition figure gives a green lite for the Ethiopian opposition to take drastic action against TPLFits wherever they are.     WWhy that is after 23 years of oppression by TPLF, Ethiopians could not achieve their freedom? The answer lies in three basic reasons:

    1) In 1998 Ethiopians committed the greatest mistake. They lined up along the side of TPLF to fight Eritrea.

    2) Ethiopian intellectuals write day in and day out about how bad Eritrea is and that concept hindered for any formidable armed opposition to flourish in Ethiopia backed by Eritrea.

    3) Ethiopians reject TPLF in a descent way and do not fight back when they are even harassed or beaten by TPLF security. It is a daily practice to see a 100-pound weighing police man can beating a 200-pound weighing protester in the open air. Hundreds of trucks line up to carry away thousands of young men and women to concentration camps and the youth willingly submit. Mind you, one person alone could disable all those trucks. There are plenty of methods they can take to avoid such illegal detention. Such things are unthinkable if Ethiopian youths were determined like the Palestinians. Avoiding the right to defend oneself is not a solution to build democracy. Democracy came to the US when it became clear that there is no winner in a fight after they went through a fierce fighting. Americans thought us the essence of the right to defend oneself. And that is how US constitution allows citizens to own arms and defend themselves from oppressive government.

    So to proclaim our rights and build democracy, we need to stop looking Eritrea as an enemy. Whatever bad happened in Ethiopia is due to TPLF. The way forward is working with Eritrea and not cursing it. A lot of effort is required to teach confused Ethiopians in this regard.This is the most important and pressing issue now in Ethiopia.

What is inherently authentic is for Ethiopians to align themselves along national agenda for unity, territorial integrity, sovereignty of Ethiopia and Ethiopians, where the last item has to do with individual freedom, liberty and equality to have precedence over ethnic and secessionist rights. Aligning with TPLF/eprdf or EPLF/Eritrea does not take us anywhere, because the two regimes the two sides of the same coin, if you remember what Issayas Afewerki sid at one time and the only time in Amharic “benena bemelese mhakel liyunet binor beeritra gudy ine ibelte ine ibet bemalet bicha new”. The Eritrean province along with either one /two ports seceded which is followed by the ideologies in the constitution of ethnic federalism and secessionism that set the condition for ethnic nationalism, future boundary conflicts armed struggle for ethnic secessionism/nationalism and an ongoing genocide. Do you believe Ginbot 7 forming a coalition with OLF and others forming a coalition as revision of AFD1, not a merger under the national agenda will bring back Eritrea to follow suit with the national agenda if and when it unseats the TPLF/eprdf regime of ex-liberation fronts which fought against the previous regimes, which never the less stood for unity, territorial integrity, sovereignty of Ethiopia, with human rights violations taken into account for the Derg Military dictatorship and TPLF/eprdf’s ethnic dictatorship. Apart for the prevalent security, federal police forces and killil administrators being supportive of the TPLF/eprdf regime, it would be hard for any armed struggle to be fought from inside Ethiopia as the case was with EPLF and TPLF, while I would not doubt the value of standing army if and when they are consolidated around the national agenda and if and when the non-violent uprising to freedom (economic and political) under the national agenda for unity, territorial integrity, sovereignty of Ethiopia and Ethiopians followed by ratification of the constitution to establish a democratic government free of ethnic and secessionist politics and/or policies with individual liberty as the centerpiece of the constitution.

    Yes but Ethiopia is not India. How can you not know this? Secondly, you need to get a representative government in Ethiopia first and then determine if, how, and which languages should become “national languages.” You may have forgotten Wagagoda was waste of money and poor planning; the plan was to create division/suspicion and rule southern region. Thirdly, if it came to deciding a national language policy priority would be for Amharic, Afaan Oromo, and Somali populations; Tigrigna would come fourth or fifth with a population of 4 million. Moreover, Tigrigna and Amharic are compatible and therefore the need is not so apparent. Let us not forget it was the great Emperor Yohannes IV who made Amharic the language of government. I know you were not born then but you could as easily have read it in history books and educated yourself. I don’t understand why you would suggest having Tigrigna for discussion in Abugida when 1 in 10 do not use it. It may be a lot easier for you to migrate to Aiga, ToL, Meskerem or even
